Comprehensive Refund, Exchange, and Limited-Liability Policy
(“Policy”) – Last Revised 12 June 2025) “Company,” “we,” “us,” or “our” means Dallas Psychic & Crystals, its owners, officers, agents, employees, successors, and assigns.
1.2 “Customer,” “you,” or “your” means the individual or entity purchasing or receiving any Product or Service from the Company.
1.3 “Products” include, without limitation, crystals, minerals, gemstones, jewelry, sage, incense, candles, spell kits, manifestation kits, oils, baths, printed materials, digital downloads, and any other tangible or intangible good offered for sale.
1.4 “Services” include, without limitation, psychic readings, tarot readings, energy work, spells, cleansings, classes, consultations, virtual appointments, digital content, and any other metaphysical or educational offering.
1.5 “Energy-Sensitive Goods” means any Product or Service the metaphysical efficacy of which is affected by energetic exchange, including but not limited to the absorption of positive or negative vibrations, intentions, or spiritual influences
2.1 This Policy governs all sales made in-store, online at https://www.dallaspsychicandcrystals.com, by telephone, via live-chat, or through any authorized third-party platform.
2.2 By placing an order, initiating a booking, accepting delivery, or otherwise utilizing any Product or Service, you acknowledge that you have read, understood, and agree to be bound by this Policy in its entirety.
3.1 FINALITY OF SALE. Due to the inherent capacity of Energy-Sensitive Goods—particularly crystals, herbs, spell components, and personalized metaphysical Services—to absorb, retain, and transmit individual energetic signatures, all sales are strictly final. No returns, refunds, exchanges, credit memos, or chargebacks shall be honored except as explicitly provided in Section 4 (Transit Exception) or Section 5 (Service Non-Performance).
3.2 Energetic Contamination. Once a Product or Service has left Company control, the energetic integrity of such item is deemed irrevocably altered. Re-stocking or re-using would compromise spiritual hygiene for subsequent Customers and contravene industry best practices.
3.3 Non-Transferability. Any metaphysical efficacy, spell outcome, or energetic benefit is highly individualized; resale or reassignment is contraindicated and expressly disclaimed.4.1 Inspection Window. If a tangible Product arrives materially damaged in transit, is missing components, or is demonstrably not the item ordered, you must notify the Company in writing at support@dallaspsychicandcrystals.comwithin forty-eight (48) hours of documented delivery, providing clear, unedited photographic evidence.
4.2 Remedy. At Company’s sole discretion, and as the exclusive remedy available, Company may: (a) ship a replacement of equal or greater value; (b) issue a store credit; or (c) provide reasonable instructions for energetic remediation. Under no circumstance shall a cash refund be granted.
4.3 Risk of Loss. Title and risk of loss transfer to Customer upon tender of shipment to the carrier. Company shall assist in filing insurance claims but bears no financial liability beyond the limited remedy in 4.2.
5.1 Virtual or In-Person Appointments. All bookings are prepaid and non-refundable.
5.2 Force Majeure. Failure to deliver a Service due to illness, emergency, internet outage, or other force-majeure event shall entitle Customer solely to a rescheduled appointment; no refund or additional damages shall be due.
5.3 Outcome Disclaimer. Metaphysical results vary according to personal intention, free will, karmic factors, and adherence to post-session instructions. Company makes no guarantee, express or implied, of specific outcomes.7.1 Follow-Through. Customer agrees to follow all cleansing, charging, usage, and after-care instructions furnished verbally or in writing. Failure to do so voids any implied warranty of effectiveness.
7.2 Energy Alignment Support. If Customer experiences difficulty achieving intended results, Company will provide reasonable after-purchase guidance (via email or short follow-up call) free of additional charge; such support does not constitute a waiver of the All-Sales-Final Rule.
8.1 Spiritual Nature. Products and Services are offered for spiritual, cultural, and entertainment purposes. They are notsubstitutes for medical, legal, or psychological advice.
8.2 No Warranties. Except as expressly stated herein, Products and Services are provided “as is” without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or results.
8.3 Maximum Liability. To the fullest extent permitted by applicable law, Company’s aggregate liability to any Customer for claims arising under this Policy shall not exceed the amount actually paid by Customer for the specific Product or Service at issue. In no event shall Company be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits or spiritual disappointment.
Customer agrees to indemnify, defend, and hold harmless the Company from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to Customer’s misuse of Products or Services, breach of this Policy, or violation of any law or the rights of a third party.
10.1 This Policy and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
10.2 Any controversy or claim shall be resolved exclusively through binding arbitration administered by the American Arbitration Association in Dallas County, Texas. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Class actions are expressly waived. If any provision of this Policy is deemed invalid or unenforceable, the remaining provisions shall remain in full force. Failure by Company to enforce any provision shall not constitute a waiver of such provision or of the right to enforce it later. Company reserves the right to amend this Policy at any time. Updated versions will be posted on the website and will apply to all transactions occurring after the effective date of the revised Policy.
